In 2005 I (american citizen) applied for a I-130 petition for my husband who is an Indian citizen. (It was approved.) Then after that the case was placed under administrative review at the Mumbai embassy in India. It is still pending for over four years now. As of Sept. 2008 My husband recieved a letter stating the petition was sent to the USCIS here for review and possible revocation. We were told to contact them here for our case. They can not find anything on our case.
He is now in Canada on a student visa. Can I apply for a K-3 visa while he is in canada on a student visa? I was told he would need to go back to India for me to apply for a K-3 visa. USCIS agent told me to take the steps in applying for a K-3 visa for him.

Nebraska Service Center mailed I-131 approval notices for me and my wife on 28th Oct. But we never received them. Its been a month now. So, I called USCIS today morning and they say I need to reapply for I-131 for my whole family because some one else might have picked it up.
I called up post office. They say they have no mails on hold.
Is reapplying the only way out?
This happened with me with Texas service center. They insisted they had sent it. But in reality they never sent it. I was told the same "You need to apply for a fresh one. That is the only way out of it." I was determined not to pay fees a second time for no fault of mine.

What if, only H4 holder (AOS pending) returns to USA using valid (till Dec' 09) H4 stamping ? Do they (at POE) come to know that spouse's 485 has been approved ?
H1 holder (485 approved) will return afer couple of days.
Urgent please help by giving your suggestions/opinions/experiences.

I'm a F1 student and presently working as a Software Engineer.I have been on OPT from January 2010 and i have recently got an extension for another 17 months which is a total of 29 months of OPT from January 2010 till June 2012, My main question was when do i need to apply for H1 and are there different types of H1?
What are the dates for applying for H1 and the start date for H1?
I will be done with my OPT by June 2012, so when should i start my H1 filling and is there any way that i can extend my status?
what are the ways of applying for H1?

Yes, you can apply for H1 extension when I-485 is pending

Once I-140 is approved, you will get an extension for 3 years.

Can anybody please let me know what are the documents needed to file for 485. If I do not have any immunization record, how can I show that immunization record?

I think your first point is valid. I would do the same thing. If you are using AP, I don't think you need to go for stamping.
Your second point is some what complicated. As your H1 is expiring in April, if you renew it later in July, it might go for consular processing, which means that you won't get the I 94 with the approval notice. In that case you need to reenter uisng a valid visa.

I had this experience in the past...when my H1 Extension is applied sometime back, they gave me a new i-94 number (probably due to an error)....however, when I left the country for a vacation, I stapled & returned both I-94's as per my attorney's suggestion (through my emp)...
In any case, please retain a copy of the same....

In OHIO I have successfully renewed my DL for 4 full years solely on original I-485 receipt.
On H1 they still give 1 year extensions.
Try doing the same in your state.

Hi Guys
I was working with a company on H1b and i left to india for a vacation on aug 13 . got stuck in india due to some personal reasons.
I got paid till aug 30 as i had leave sanctioned till aug 30.
came back to US on dec 30.
Didnt get paid for the month of sept oct nov dec.
But i was never out of status as I was in india.
now can i apply for a h1b trasnfer as i m getting a job with a very good company with good salary.
i have paystubs till aug 30 2009. never out of status .

What happens to the people who graduated from the institute and applied for gc on its basis?
It depends. If the University was never accredited by a recognized accreditation board, then USCIS would never have accepted that degree. If it was accredited before being shut down, then you might stand a chance. But if as someone has posted the university never had a .edu domain, then I doubt it was accredited by a recognized board at all.

Is there any way we can check our labor processing status as it is a genral fact that no employer would prefer to give his employee to access his status and at the same time they would not let employee to call attorney directly.So in this kind of scenario I was just wondering is there anyway we can track the status.
