My wife is currently on H-1B status. Her employer has decided to close the company and cancel her H-1B effective from 2/28/09. My wife has an EAD and Advance Parole. We applied for her EAD and Advance Parole, when my company applied for my I-485 Adjustment of Status in July 2007. I wanted to know:
a) What steps are needed to move my wife from H-1B to EAD?
b) Do I also need to move from H-1B to EAD in order for my wife to use EAD?
c) Do I need to move my wife to H-4 status before she can start using her EAD?
In short I wanted to inquire, how to ensure that she is still in legal status after her H-1B is cancelled by her employer?
She will be in legal status although her H1 is cancelled.
Reason - She has file I-485 with you, so technically she is in AOS(Adjustment of Status)
When she finds a new job she will give her EAD details in the I9 form.
You dont have to do anything. You can maintain your H1.
If you convert her status to H4 then she cannot use EAD - meaning she cannot work being on H4.

Can someone please explain why copies of the passport (showing biographical data) are required? Which form asks for them - I did not find anything in I-485. That form only asks for a copy of the visa, if issued within the last year.

Guys,
I switched my job in first week of October this year and My new employer filed the H1B transfer petition on Sep 26 (USCIS Receipt date). It has been almost two months and USCIS online status still shows case received and pending, while California State Center processing dates shown Oct 15 which is 20 days after Sep 26.
Is there anyone who has expereineced the same and want to share?
I am bit concerned because my employer has started the GC process and will be ready to submit the PERM application in few weeks.

TSC online system seems to be still down - I tried adding a new receipt number and its not accepting, I talked to my lawyer and she mentioned that she heard same from a bunch of her other clients. Since my EAD is still valid for another couple months, I didnt try to go for InfoPass yet.
These days people are getting RFE's left and right and TSC's online system is down just in time :( In many cases it may not be a big deal (to answer the query in time) but having online system updates was useful to prepare for any such thing. Now we have to wait for the letter.

OK...I just got an email from my Attorney. It is indeed what she thought. She received our receipts today from the CSC. The receipts have a receipt date of July 23rd and a notice date of September 19th. As to why the CSC sent out the other notice transferring the case back to NSC to me only and not the Attorney...that is a mystery. She plans to speak to our State Senator and hopefully get some answers.

When submitting AR-11 form online, you will be given an option to update the address on your pending applications, this will update address on your I-485. Once the AR-11 and G-28 forms are submitted, follow up in a couple of weeks by calling customer service to verify that your records has been updated with the correct address and attorney information. Also, if possible try retaining your previous attorney for your case, this is always a safe option.

I came across a posting today for a local contract position, which was a good match for my profile. But when I sent my resume in, the vendor said we cannot proceed because the end client asked for either citizens or GCs. I thought it was strange, because it is a contract requirement, not fulltime. This is the first time that I have encountered someone requiring a GC for a contract posiiton. Further, this is not a defence or state department kind of deal where you'd need citizens. My attorneys filed Labor with the missing job information like in the allien job experience section. i saw the the current job start date is wrong then the job 2 is put with the wrong dates. Job 3 is not there. I got a audit as ******** is my attorney as special audit. when I contacted they said its electronically filed then can't change. They will take care in later stage.Then THE LABOR IS CERTIFIED. Now I see nothing has been taken care. they are filing I-140.
Now my question is if i get RFE in I-140 in future and I send the experience letters obviously which will be different date( as labor is approved with aliens wrong info in experince).
PLEASE members let me know the complication.. am getting really worried..Let me know what to do.

As far as I know both the client and vendor letters should state the same and it is good if you have it for 3years.

i think at re-entry for the 485 pending /AP applicants, there is a POSSIBILITY that the officers could question you bout ur existing employment. For such cases people r adviced to carry the current employers letter along with copy of 485 receipt for safety sake.
with that in mind, if all possible, using ur EAD(after that 180 day rule) , get a job may be collect a paystub or 2 , get a letter and then use the AP.
in many other forums, pple have shared info such as "officer asked me if im still employed with the same employer who filed for GC." etc etc . its better to carry something atleast to prove that when asked.

Can I leave US before my AP gets approved, hoping that it will be approved in the next 2 months time and my attorney will send the AP papers to my India address?

You can file H1-B extension based on your approved i-140 you should receive another 3 yrs extension i did the same.
